The Rock of Gibraltar, which has taken all that could be thrown at it over hundreds of years, including the repelling of Hitler’s German forces during the entire Second World War, is about to crack and fall.
In five weeks’ time the residents of Gibraltar, who voted 99% to remain British in their referendum, will in effect become Spanish, subject to EU laws and taxes, and with the Spanish deciding who can enter and who can stay.

The United Kingdom’s last outpost in Europe of British civilisation and projected power is about to fall, under the terms of a new EU Treaty negotiated and allegedly agreed by Sir Keir Starmer’s government.

REPORT SUMMARY

TREATY SUMMARY
Below is a small selection of typical obligations contained in this travesty of a Treaty
Firstly, Facts4EU discovered an “EXPLANATORY MEMORANDUM” within the EU’s enormous legal database.
“The entry into application of the Agreement is a matter of special urgency.” It goes on to state that “In light of these exceptional circumstances” the Agreement should be applied “from the date of full deployment of the Entry/Exit System… by 10 April 2026.”
That is just five weeks’ away and the UK Parliament has still not been presented with the full legal text to discuss.
Border Control
There will be no hard border between Spain and Gibraltar – it will almost be as one territory. Spain decides who is allowed in to Gibraltar.
“For the purpose of this Agreement the competent authorities of the Kingdom of Spain shall perform any functions which are required to exercise border control, comprising border checks and border surveillance, as set out in the Schengen Borders Code and related tasks under Union law.”
Spain must approve you in advance if you want to visit the Rock : Electronic “Advance Passenger Information” on travellers landing in Gibraltar is to be provided by the UK to Spanish authorities in advance.
Spanish officers will patrol Gibraltar
In addition to the airport and port, Spain can patrol to question people outside the immediate boundaries.
Spanish officers have the right to “arrest, search, detain, interview, place under protection a person, or seize or search property, where it is justified in the course of border control carried out by the competent authorities of the Kingdom of Spain.”
This means uniformed and armed Spanish officers on British soil, policing British territory.
EU law will once again apply in “British” Gibraltar
“The United Kingdom, in respect of Gibraltar, shall have in place in its domestic law, and effectively apply, the same provisions as those contained: (a) in the Union acts listed in the provisions or in those Annexes to this Agreement…”

The Treaty will control almost all aspects of the lives of Gibraltarians

It’s Back To Gibraltar As If Brexit Had Never Happened – Only Worse
Where standards on a wide variety of subjects are described, these may not be altered below what was in place when the UK left the EU. In other words, Gibraltar must follow EU law once again, as if Brexit had never happened. What makes it worse is the control the Spanish have over everything.
Taxation, trade tariffs, VAT
These will all have to be harmonised to avoid any “conflicts” with the regime in Spain. This will result in some considerable increases in taxes for ordinary people and for local businesses.
The airport to be controlled in the EU
An EU-based Gib/Spanish airport management company will be established in an EU country to manage the airport, despite the fact it is on Ministry of Defence land. Similarly, the EU will decide which ships will be allowed to dock at the port and these must be from approved countries.
Spain will closely monitor all movements of UK military personnel
For UK services personnel based in Gibraltar, they must show all their details in full, which will be recorded. For non-resident troops arriving on the Rock, the Spanish will also require their movement orders in English and Spanish and these will also be required for NATO forces on exercise with British troops. The Spanish will know everything about deployments. Spain will also have the right to refuse them entry.
Freedom of movement for the EU but not for the Gibraltarians
Gibraltar residents do NOT get freedom of movement into the EU. They can travel: “without a visa for a maximum period of 90 days in any 180-day period.”

“This Treaty is being rushed through with late publication and little publicity. Why? Can they sustain their claim they have preserved UK/Gibraltar sovereignty? You are not sovereign if others impose taxes and laws on you.
“The government needs to spell out how many EU laws will apply in Gibraltar, how quickly Gibraltar will have to adopt new law, and how much extra tax they will be asked to pay. Gibraltar has to join the EU Customs Union where the UK has removed duties from many products when we left. There will be handling charges and other tax requirements.
“What are the full costs of all the EU rules? How much will they have to pay to Spain level up the adjacent area? This looks like a fixed menu with no choice and no printed prices, where the final bill will come as big shock and will not represent value for money.

Eurocracy will descend over the Rock like a cloud
The weight of EU bureaucratic requirements for the UK Government and Parliament, as well as for the Gibraltar Assembly and ordinary Gibraltarians, will once again descend over this British territory, with new legislation continually enacted.
Additionally there is a requirement to set up a great many Cooperation Councils and Specialised Committees to monitor an enormous number of activities and laws. The purpose is to check the UK is behaving itself. If not, naturally the UK can expect to be hauled before the EU’s court.
The final question about this abominable new Treaty is “WHY?”
The official answer concerns the EU’s new entry/exit IT system, which is being implemented on 10 April – in just five weeks’ time. The justification for this entire Treaty is allegedly so that 13,500 Spaniards, who would otherwise be unemployed in southern Spain, must be able to cross the border into Gibraltar easily every day to work.

It must be asked why this Treaty could not have been discussed over a more reasonable timescale, rather than waiting until a war is raging in the Middle East, which involves the UK and its military bases.
What do the Gibraltarians think?
It might be thought that Gibraltarian political leaders would be the first to be opposing the Treaty as we have described it above. In fact, Chief Minister Fabian Picardo has always been in favour of a Treaty with the EU. So much so, that Facts4EU has had reason to doubt his motivation over many years. The most important question here is the UK's sovereignty over Gibraltar, rather than the details of any deal which may or may not benefit certain parties.
The population of Gibraltar is more akin to that of a medium-sized British town than of a country, which may help readers to understand that its Assembly is closer to that of a Town Council than a government. It remains to be seen how Gibraltarians will react if this Treaty goes ahead and they see their cost of living rise significantly and the prevalence of a new level of Spanish interference in their affairs which they had not been advised of.
On Tuesday in the Gibraltar Assembly, the left-wing Opposition leader Mr Keith Azopardi was astonishingly critical of provisions in the treaty. In summary, his only, very reluctant, reason for acceptance was based on the firm understanding that the Treaty could be annulled, even though this has not yet happened with any treaty with the EU that has been signed by the UK.

“While we see the benefits we also see high prices in exchange, in terms of red lines crossed or basic economic uncertainties that can go badly wrong or powers conferred on Spain that can be abused or simple instability that can be created to our economy, way of life or political viability.”

Observations
As war rages in the Middle East, dominating the news agenda, we are only weeks away from the EU wanting to apply its new Gibraltar Treaty to the UK. Despite what the Government - and the Gibraltar Assembly leader Fabian Picardo may say - this Treaty is the worst we have read in 10 years of working seven-days-a-week on matters relating to the UK and its independence.
This Treaty is so contrary to British interests we would go as far as to call it grotesque. Quite how any British Government could even begin to contemplate agreeing to such an instrument is completely beyond us.
