TERRORIST ATROCITY IN NICE, FRANCE

Bastille Day tragedy
FROM OUR SOUTH OF FRANCE CORRESPONDENT
A few short hours ago we were celebrating Bastille Day with music, dancing, food and wine, and fireworks.
Under cover of fireworks, a 31 year old man of Tunisien origin drove 2km down the Promenade des Anglais of Nice, ploughing through the crowds of French people and tourists who were celebrating French independence day. He fired at people with a revolver before French police shot him dead. French TV is now reporting at least 80 deaths and a very large number of injured.
Bastille night is a family event, with children of all ages being allowed to stay up and enjoy the festivities. The perpetrator will have known this, but it didn't stop him from driving into families with young children.
For anyone worried about relatives or friends, the French emergency number is 00 33 1 43 17 56 46, although the UK Foreign Office will no doubt have their own number.
President Hollande has already announced that the State of Emergency which was due to expire in 12 days has been extended for 3 months. The reserves of police, civilian reservists, and some army units have been called up.

  • Mrs May has halved the voice of the Leave majority in Cabinet
  • Adding in those who aren’t full members but who attend, percentage drops to 20%

This was hardly the upbeat, confident, and optimistic first interview the World should hear with the UK's new Chancellor.
This is what happens when you appoint pro-Remain politicians who refuse to damage their own reputations by presenting a new and positive case for a bright future outside the EU.

SO, WHO WILL MAKE THE BREXIT DECISIONS?

From the perspective of the EU’s capitals, the next few days will show who’s in ultimate charge of the UK’s negotiations with the EU.
  • Just like the UK, the power in most EU nations is generally in the top two positions – the equivalents of the UK’s Prime Minister and Chancellor
  • Eg Germany: Merkel (Chancellor) and Schauble (finance); France: Hollande (President) and Macron (finance)
  • The UK now has pro-Remain May and pro-Remain Hammond in these two positions
  • If the new role of ‘Secretary of State for Exiting the European Union’ is to be taken seriously in continental Europe, Mrs May must make it clear that the pro-Remain Chancellor has a subordinate position in relation to EU Brexit negotiations
  • It must be clear to EU leaders that David Davis’ role is pre-eminent and that he will be the driving force, with her full backing
  • Mrs May must find a form of words for saying that the new Chancellor will only play a subordinate and supporting role

Hammond tells Parliament it will take 6 years to exit EU
  • Alex Salmond: "Will it take longer to negotiate Brexit than [the 6 years of] WWII? How would any future Chancellor of the Exchequer deal with such uncertainty?"
  • Philip Hammond : "if a future treaty between the UK and the EU 27 is deemed to be a mixed competence, it will have to be ratified by 27 national Parliaments. I believe I am right in saying that the shortest time in which that has been done in respect of any EU treaty is just under four years—that is after taking into account the time it takes to negotiate."

Facts4EU.org is party-neutral. We comment only on matters relating to the UK's position on the EU, on broad principles of democracy and governance, and on the UK's relationship with the rest of the World.
OPEN LETTER TO MRS MAY ON CABINET POSTS
Dear Mrs May,
Now you’re forming your new Cabinet. The decisions you take in the next 24 hours will play a major role in defining the shape of British politics – and your Party - for decades to come.
As a key Minister in Mr Cameron’s administration, you participated in the most extreme form of Government manipulation and abuse of power we can recall in any political contest in the UK.
The people of the UK spoke on June 23rd and we suggest that it would be wise to listen to the angry groundswell of opinion across the length and breadth of the Kingdom which wasn’t persuaded by your Government’s propaganda.
We simply wish to state for the record that any appointments you make which involve George Osborne, Philip Hammond, Amber Rudd, and Anna Soubry, will tell the voters all they need to know.
Osborne must leave Government after his disgraceful role in Project Fear. Hammond has presided over the politicisation of the Foreign and Commonwealth Office to such a degree that it shames the independent principles of the Civil Service. His arrogance and disregard for the views of the people make him as unfit for office as Osborne.
Rudd and Soubry share Hammond and Osborne’s arrogance and together all four will drive voters into the arms of other parties. Should you appoint any of them to high office, it is our opinion that you risk the radical reshaping of British politics and decades of divisive coalition government.
Finally, it is not enough to say “Brexit means Brexit” – trust in politicians is at a very low ebb.
The people voted to leave the European Union. This means complete repatriation of all laws and lawmaking, complete control over our borders and immigration policy, total removal from the Single Market, and no payments to the EU.
It means being an independent country again, trading with the World, and trading with the EU in a businesslike way as other countries do. It means playing our significant and influential part on the World stage, unencumbered by the failed 1950’s ideology of the EU ‘Project’.
We very much hope you will take this opportunity to unite the country with a positive and appropriate team to drive us forward and we wish you well in this endeavour.
P.S. We ask you again to reconsider your inhumane policy and now assure all existing legal EU immigrants that they are welcome to stay.

If you wish to show that you now back Brexit, you should commit to invoking Article 50 by Royal Prerogative before October.

These are the firm conclusions of a legal review by eminent, EU-specialist Martin Howe QC and team from Lawyers for Britain.
  • Referendum was in fact constitutionally binding on Government, not ‘advisory’
  • Government “mandated to exercise its legal power to give notice under Article 50”
  • Legal power over Article 50 is vested in the Crown, exercised by Government Ministers, without need for Parliament’s approval
  • “No credible legal argument” supporting legal challenge by law firm Mishcon de Reya
  • Government has now rejected petition for 2nd Referendum
This legal review shows unequivocally that the Referendum is binding, that the Government is mandated to give notice to EU under Article 50, and that challenges by the legal elite are politically-motivated.

1000 barristers send letter to PM demanding Act of Parliament before Article 50 triggered
Letter gives no valid legal or constitutional reasons
Instead it focuses on vague political statements
  • “Parliament is the guardian of our democracy”
  • “At this time of profound constitutional, political and possibly social and economic crisis, we look to [MP’s] to fulfil the responsibility placed upon them”
  • Referendum result “was influenced by misrepresentations of fact and promises that could not be delivered”
The last statement above is so naive and so overtly political, we struggle to understand how more than 1000 barristers - from whom our future judges will be drawn - allowed themselves to be persuaded to sign this letter. A letter from 1000 barristers would normally be expected to be about the law rather than being about their political beliefs.
Eminent QC Martin Howe goes further: “Clearly there is something seriously wrong with legal education today if 1,000 barristers can be found with such deep ignorance of the British constitution”

This is currently an exclusive and we thank the Rt Hon Dr John Redwood MP, distinguished former Minister, for his kind permission.
  • Q: Why during your six years as Home Secretary has net migration risen so high and remained at very high levels, when you were pledged to cut it to tens of thousands in both the 2010 and 2015 Conservative Manifesto?
  • A: These are difficult and complex matters. The actions taken have reduced the totals compared to what would otherwise have happened. More measures are being considered.
  • Q: Why will you not reassure people currently legally settled here from other member states of the EU that they can stay following the UK’s exit?
  • A: It is important to negotiate these matters as part of the total package with the EU, which will take time and will be difficult.
  • Q: Will you today make an urgent statement saying that future migrants from the rest of the EU will come under new rules which will impose some limits on numbers.
  • A: No
  • Q Will the Home Office start immediate work on a new system of migration control?
  • A: No
  • Q: What changes would you like to see to taxes, spending and borrowing going forwards?
  • A: The reply made a joke about the individual MP asking but did not give an indication on any of the three possible topics raised
  • Q: How quickly would you seek to get the UK out of the EU?
  • A: Consider options and issues this year. Trigger Article 50 early next year and anticipate 2 years of difficult negotiations about a wide range of issues.
  • Q: Did you deliberately soft peddle campaigning in the referendum for Remain because you were not convinced by their case?
  • A: No. She said she campaigned with full commitment to the Remain cause. She also had to carry on work as Home Secretary. She made the good point that she did not say anything unusual or sensational, so the media did not find her remarks newsworthy.
  • Q: Will you negotiate firmly with a strong wish to leave the EU?
  • A: Yes, she accepts the verdict of the referendum. She will appoint a Brexiteer to a senior role in the negotiations.
A fascinating insight into the mind of Theresa May as she addressed hundreds of Tory MP's.

Mrs May should follow her lead.
EXISTING IMMIGRANTS – A QUESTION OF MORALITY AND DECENCY
Throughout the Referendum campaign, the Leave side promised to honour rights of existing immigrants.
Existing legal EU immigrants would not undergo forced repatriation. This was Vote Leave policy, as well as UKIP and Leave.EU policy.
Now Mrs May wants to use 3 million EU immigrants as bargaining chips in EU negotiations.
NO, NO, NO, Mrs MAY
That would be immoral and wrong.
It's simply not British.
People have set up homes, have jobs, have children in school, etc
It would not be right to ask them to leave, when they came here legally.
We ask her once again to reconsider her inhumane policy and now assure all existing legal EU immigrants that they are welcome to stay.

If Remainer Mrs May wishes to show that she now backs Brexit,
she should commit to invoking Article 50 before year-end
by Royal Prerogative.

  • A: “I'm not sure I see the need,” replied Philip Hammond, Foreign Secretary
  • Q: “The Government appears to have taken a decision to put the country in a place where there was no contingency plan for a leave vote,” asked Crispin Blunt
  • A: “Chairman I can assure you it wasn’t an oversight,” replied Philip Hammond
  • “We discussed this question before the referendum began," he continued, "whether there should be contingency planning or not. We concluded it was not appropriate to carry out contingency planning, other than planning that was focused on the very immediate pressures that might come on the financial markets.”
This is gross incompetence and the top tier of the Cabinet must resign

The Head of the Civil Service must resign
In General Elections the Civil Service makes plans for alternative outcomes
For the Referendum they made none, apart from immediate statement from Governor of Bank of England on day of result
At the Foreign Affairs Committee yesterday, the Chairman questioned the Head of the Diplomatic Service :
  • Q: “Don’t you think you should have been carrying out some kind of preparation within the Department?,” asked Crispin Blunt MP, Committee Chairman
  • A: “The Civil Service including the Diplomatic Service works for the Government of the day,” said Sir Simon McDonald, Head of Diplomatic Service, with smug, patronising smile
  • “One thing we knew through this campaign is that the Government would remain in place until 2020." he continued.
No they didn’t know that, and the PM resigned on the morning of the result. In any event it still doesn’t answer why they made no plans for a Leave vote

The problem is that he’s been using his position of Governor of the Bank of England to make political and self-aggrandising TV appearances and is talking down our economy. We’re a tad old-fashioned over here and we have this idea that the Governor should be non-political and should maintain confidence in the economy.
Over the last few months and at the encouragement of our Chancellor George Osborne, we’re afraid Pretty-Boy participated in the presentation of an apocalyptic vision of Brexit.
Now that his post-Brexit predictions are proving false, he’s been forced to make more and more TV appearances (more than our Prime Minister in fact), to prophecy doom and gloom in an attempt to make his prophecies come true.
It’s costing us a fortune! Would you mind taking him back now please? We’d be terribly grateful. His salary is only £880,000 per year.

Legal challenge issued at High Court to block Article 50
As predicted here on the day of the result when we launched our ‘Leave Means Leave’ campaign, the establishment is moving to block the democratic will of the British people to leave the EU.
  • Top law firm says "Legal steps have been taken" on behalf of unnamed clients "to ensure that the Article 50 notification process is lawful"
  • They are seeking to block Government from invoking Article 50 (to leave EU) without legislative act first being passed by Parliament
  • Chairman of pro-Brexit Lawyers for Britain Martin Howe QC said proposed action "devoid of all legal merit"
This is why we urged last week that Article 50 be invoked quickly.
We continue to urge the Conservative Party to move much faster to replace David Cameron.

Leadsom had been actively campaigning for a renegotiation and Referendum
  • Leadsom (and the public) were expecting Cameron to negotiate serious EU reforms
  • Leadsom's speech is full of criticism of the EU in every respect
  • The pro-EU media have given one selective comment from Leadsom’s speech in 2013
The establishment media this morning failed to give the public any of what Leadsom said next in her 2013 speech, so we will
  • “On the other hand I think the status quo is fundamentally damaging, not to just to Britain’s propects from too much red tape, but also to our sense of justice, fairness, accountability and good governance.”
  • “There are too many laws decided in Brussels which would be better decided by our national Parliament.”
  • “For the EU to succeed, returning powers to nation states is in my view utterly vital
  • “And the opportunity for fundamental reform is right now
  • “The status quo in the EU is simply not an option”
Leadsom was a consistent Leaver before and during campaign.

May declared for Remain and then hid away from the voting public.
Yet suddenly May is now on the news every day.

1. THERESA MAY – HID AWAY
It is simply inconceivable that a pro-Remain candidate could take Britain forward and take advantage of the wonderful opportunities which lie ahead for the UK in our exciting global future.
In particular, readers will recall that we issued a ‘Missing Persons Notice’ for Theresa May during the campaign.
Someone who hid from the public during the campaign, in order to keep her leadership options open, does not have the qualities required to lead the country.
  • Theresa May has been Home Secretary for 6 years – impressive achievement
  • However immigration rocketed under her, despite promise to reduce it
Mrs May also made deeply troubling comments on Thursday about Brexit
  • "to regain 'more' control of the numbers of people coming here from Europe"
  • Note she didn't say 'control', she said 'more control'. In other words, she will negotiate on free movement, which is not acceptable in terms of what the British public voted for.
We simply do not believe Ms May can present an optimistic and exciting UK future to all voters and will be unable to unite the country.
2. STEPHEN CRABB - REMAINER
An impressive candidate who has a great future in Government, but he is disqualified from leadership at this time by virtue of him supporting the UK's membership of the failing EU superstate.
We also feel he made a serious error in choosing Sajid Javid as his Chancellor-nominate. Mr Javid was also a Remainer and made the most bizarre and inconsistent Remain announcement of any we read this year.
So it’s Andrea to lead us into a better, brighter, more prosperous Britain with a global future

Months of talking down the economy; he can’t be credible to the rest of the World

“The pound would fall in value – by between 12% and 15%”
“Within a year of the Referendum, inflation would be over 2% higher”
“Within two years, at least half a million jobs would be lost”
“across Britain as many as 820,000 jobs could be lost”
“Youth unemployment would rise by over 10%”
“real wages will fall by almost 3% in the first two years”

Well, you did it. You persuaded 17.4 million people to vote to leave the sclerotic and failing European Union. The biggest vote for anything in British political history.
You overcame the greatest concentration of international money and power I’ve seen in a democratic process during my lifetime.
Many of you put in long hours putting across the arguments door-to-door, on stalls, and at debates. You reached huge numbers of voters and it gives us great pleasure that many of you used the exclusive and original facts from this site.
And our readers who are Ministers, former Ministers, MPs, MEPs and Councillors were able to use our facts in their speeches and in debates. We were but one part in the jigsaw but yes, we feel a sense of satisfaction this weekend as everything sinks in.
Thank you to all who donated. You were a tiny fraction of our readership but we appreciate your contributions from £20 upwards. Every single donation helped to keep us going, even though we’ve now been left with big bills to pay ourselves. (Sigh)   If you can help us, see below.

The UK economy is sound, and it's now free of the failing economic and political construct that is the EU.
Relax. Things are going to get so much better.

The voters faced the combined weight of a very partisan Government, Big Business, Big Banks, CBI, TUC, all major parties except UKIP, the EU Commission, Angela Merkel, Francois Hollande, all other EU leaders and elites, IMF, WTO, etc, goodness knows how many high-salaried 'experts', last-minute changes to voter registration, taxpayer-funded propaganda, and much more.
In a more balanced debate, the margin would have been much, much higher.
But for now let's just celebrate!
